The main objective of the Course is to raise awareness of a legal field that is still unfortunately little used, but of great interest not only systematically in relation to the multiple dispute resolution systems, but above all for its positive social and economic repercussions. Already the Ministerial Decree of 23.12.19 had considered “the need for an in-depth systemic survey of existing extrajudicial procedures and their possible increase in order to contribute to the deflation of judicial litigation and to the enhancement of access to justice for all citizens”, believing that it was necessary to consolidate the Italian ADR system by developing innovative models and good practices, advocating their dissemination throughout the country also to foster the implementation of relations with ADR Policy Makers at the European level. Moreover, Directive 2008/52/EC, whose objective was to facilitate access to alternative dispute resolution (ADR) promoted amicable settlement, encouraging recourse to mediation to ‘...bring about a non-contentious culture in which there are neither winners nor losers but partners’.
